1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the SEALessons.guru website and online classes and related services provided by LingoClinic (“we”, “us”, “LingoClinic”). By creating an account, purchasing a class, or clicking “Join” to enter a live class, you accept these Terms and our linked policies (including the Privacy Policy). If you do not agree, do not register or join a class.

2. Definitions

  • Parent / Customer: the adult who registers an account and provides consent for a Student to participate.
  • Student: the child who attends classes under Parent’s account.
  • Account: the Parent’s registered user account on SEALessons.guru.
  • Session / Class: a scheduled live lesson delivered via third-party meeting software or hosted platform.
  • Tutor / LSA: LingoClinic staff who deliver or support Sessions.
  • Content: course materials, recordings, Captivate modules, resources, and assessments provided in connection with Sessions.

3. Eligibility; Parent-Only Registration; Consent

  1. Only adult parents or legal guardians may create Accounts and register Students. By creating an Account you warrant that you are the Student’s parent or legal guardian and have authority to provide consent on the Student’s behalf.
  2. At signup you will be required to provide consent to LingoClinic’s processing of the Student’s educational data, recordings, and related uses described in these Terms and our Privacy Policy. We will retain an auditable consent record.
  3. You may withdraw consent or request deletion of your child’s data through the Parent Portal; withdrawal will not retroactively affect lawful processing already completed.

4. Services; Delivery

a. SEALessons.guru provides scheduled group and 1-on-1 classes delivered by Tutors and supported by LSAs using Adobe Connect or similar third-party platforms. Schedules and content may change as operationally required.

b. Classes are delivered synchronously. Students cannot cancel or reschedule Sessions.

5. No Guarantees

LingoClinic makes no guarantees regarding academic outcomes, grades, exam results, or improvement.

6. Fees, Charges & Payment Terms

  1. Fees are posted on SEALessons.guru and payable in advance. Registration fees, where charged, are non-refundable except as set out below.
  2. By paying you authorise the use of the payment method you supply. Third-party payment processor terms apply.
  3. Refund policy: Except for the limited satisfaction exception below, all fees are non-refundable and non-transferable.
7-Day Satisfaction Exception: Within 7 calendar days of the first paid Session, a Parent may request a full refund of payments made for SEALessons.guru services for any reason. To qualify: (i) the Parent must complete the required satisfaction survey; and (ii) submit the refund request within the 7-day window. Approved refunds will be issued within 30 days of successful application.

7. Cancellations, No Make-Ups & No Refunds

  1. No refunds or make-up classes will be provided for student absence for any reason.
  2. No refunds or make-up classes are offered for public holidays, including Carnival Friday to Carnival Tuesday.
  3. No refunds or make-up classes are offered due to internet service failure or connectivity issues on the student’s side.
  4. If LingoClinic cancels a Session for operational reasons, we may reschedule or issue a credit at our discretion.

8. Recordings & Media Use — Grant of Rights

a. Sessions may be recorded for quality control, compliance, training, and promotional purposes. Recordings may include both audio and video of Students who appear or speak in class.

b. By registering, the Parent grants LingoClinic a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, publish, distribute, modify, or otherwise exploit any audio or visual recording of the Student captured during Sessions for any lawful purpose, including advertising and marketing.

c. Parents who do not wish their child’s likeness to be used in marketing must email lingoclinic@dottcorp.com before the first Session; accommodation is not guaranteed.

9. Conduct & Safeguarding

  1. Students must behave respectfully. Tutors/LSAs may mute or remove Students for violations.
  2. Where a safeguarding concern arises, staff will follow LingoClinic’s safeguarding procedures and may report to appropriate authorities.
  3. Misconduct may result in account suspension or termination without refund.

10. Privacy & Data Processing

  1. LingoClinic processes Student and Parent data to deliver services, assessments, attendance tracking, billing, analytics, and compliance. Details are in our Privacy Policy.
  2. Consent records, logs, and necessary operational data may be retained for compliance purposes.
  3. Third-party tools such as Adobe Connect and payment processors process limited data under their own terms.

11. Intellectual Property

All content and materials remain the property of LingoClinic or its licensors. Parents and Students receive a limited license for personal educational use only. Redistribution or reproduction is prohibited.

12. No Warranty; Limitation of Liability; Indemnity

  1. Services are provided “as is” without warranties of any kind.
  2. LingoClinic’s liability is limited to the total fees paid for the affected Sessions.
  3. You agree to indemnify LingoClinic against claims arising from your misuse of the services or breach of these Terms.

13. Suspension & Termination

  1. We may suspend or terminate Accounts for non-payment, misconduct, safety concerns, or breach of these Terms. Refunds are not owed except for the 7-Day Satisfaction Exception.
  2. Parents may close an Account; closure does not erase prior records unless required by law.

14. Third-Party Services

Sessions rely on third-party platforms. Outages or disruptions in these services are outside LingoClinic’s control.

15. Notices & Communications

Official notices must be sent to lingoclinic@dottcorp.com or the postal address listed above.

16. Governing Law

These Terms are governed by the laws of Trinidad & Tobago.

17. Changes to Terms

We may update these Terms. Continued use after changes means you accept the updated Terms.

18. Entire Agreement & Severability

These Terms and the Privacy Policy constitute the entire agreement. If any provision is invalid, the rest remain in effect.
